Terms & Conditions

I. Introductory Provisions

1. These Terms and Conditions apply to the purchase and use of the Accent Artisan educational application license at www.accentartisan.com (hereinafter referred to as the "Application") operated by Accent Artisan s.r.o. Na Balkáně 1361/28 Praha 3 Žižkov, Czech Republic 130 00 IČO:03282601 (hereinafter referred to as the "Operator"), contact email: support@accentartisan.com.
2. A user of the Application is any individual or legal entity that creates a user account (hereinafter referred to as "User"). Creating a user account consists of entering an email address, username and password.
3. The Application is a web-based service primarily intended to facilitate foreign language learning through freely available publications.

II. License conditions

1. Property rights to the Application under Act No. 121/2000 Coll. on copyright belong to the Operator.
2. The Operator hereby grants the User a limited, personal, non-transferable license to use the Application.
3. Subscriptions can be paid using the GoPay payment service (including debit and credit card payments) or by transferring the necessary funds to the Operator's account. The ordered service will be activated within 1 hour after receiving the payment (for instantaneous payments via GoPay) or within 24 hours after receiving the payment on the Operator's account (for payments via bank transfer).
4. Access to the Application is ordered for a limited period – 1 month, 3 months or 12 months. When activating a newly ordered and paid subscription, the time period of the existing subscription is extended by 1, 3 or 12 months (according to the order).

III. Users’ Rights and Obligations

1. A user agrees not to use the Application in any way that would violate the Operator's rights.
2. A user is not entitled to lend his/her username and password to third parties - accounts are non-transferable and unsalable. They only belong to you.
3. The Operator is entitled to cease all services of the Application towards a user who is reasonably believed to violate these Terms and Conditions.
4. In the event of any breach of these Terms and Conditions, the Operator reserves the right to immediately cancel the user's in question user account without reimbursement.

IV. Payments

1. The first three days of accentartisan.com course are free. If you choose not to continue you don't have to do anything. Don't worry, we won't send you any invoices :-).
2. The language course is paid starting with day 4. It is paid in the form of a subscription according to the price list of services listed on the Operator's website: Price list
3. The relevant tax document in the form of an electronic PDF document is sent to the user's e-mail address within 24 hours after receiving of payment to the Operator's account.
4. The Operator reserves the right to change subscription prices at any time. However, any of these potential price changes will not affect existing subscribers.
5. The Operator reserves the right to announce discounts and any other events at any time of which it informs on its website www.accentartisan.com or elsewhere.
6. The Operator reserves the right to inform Users of new lessons via email. Specifically, one notification pertaining to a missed lesson and monthly news. Users can unsubscribe from this subscription at any time.

V. Payment options

1. Payment for using the application can be made by bank transfer to the Operator's account 8181436001/5500 (be sure to include your email in the note and send us your billing information to support@accentartisan.com) or via GoPay.
2. The User is entitled to use the Application with all its features for the duration of the subscription without any additional payments.
3. At the start of the course, each user earns a $10 credit towards talking to native speakers through italki.com.
4. Any User, who has completed the first two talks through Italki and is able to provide their ID numbers will receive an additional $20 discount from the subscription price. If he/she is able to prove additional interviews through Italki, we will send the User another $20. This option is valid for the 3 month or longer subscriptions. Not applicable for students and ZTP (severe health disability). The maximum amount of credit is $50.
5. The application is accessed through the user's username and password. This data is confidential and non-transferable. The user is responsible for keeping this information confidential.
6. The Operator reserves the right to change the appearance of the Application at any time, update the Application with new features and to modify existing features.

VI. Guarantee and Warranty

1. The Provider offers a 100% money back guarantee within 14 days of purchase (full refund) in case the User is dissatisfied with the Service purchased. This refund does not include the already used credits for conversations through italki.com (will be deducted if applicable). We are also unable to refund through Benefit Plus.
2. The Operator expressly makes no warranty of the Application in other points. The Application is provided as offered without warranty of any kind, either stated or implied.
3. The User bears all risks associated with the use of this app. In no situation shall the Operator be liable for any damage resulting from the use of the Application, whatever it may be.
4. The Operator warrants that the Application operates in accordance with its description available on the accentartisan.com website. If, during the subscription period, the User finds the Application behaves in contradiction to the description found on accentartisan.com, the User will provide the Operator with an accurate description of the detected problems (via support@accentartisan.com). In the event of a such problems preventing the use of the Application, the Operator repairs the problems immediately and free of charge.
5. In the event of unavailability of the Service caused by either the Operator, internet service provider, a hacker attack, force majeure, etc., the Operator will do everything to ensure the Service is operational again as soon as possible. In the event of an extremely prolonged Service unavailability, the Operator will, on the User’s request, extend the subscription period for the time for which it was unavailable.
6. The User is free to test the Application free of charge for five days (tools) or three days (lesson) before ordering. This period starts from the moment of registration and the first entry into the Application. By ordering a subscription, the User acknowledges that he/she has been fully familiarised with the Application and its features.

VII. Personal Data Protection

1. The Operator collects and protects all the personal data provided by the Users in accordance with Act No. 101/2000 Coll., on Personal Data Protection.
2. A Users' personal data will only be used to realise the execution of the user agreement and will not otherwise be disclosed or made available to a third party.
3. By registering or sending an e-book, the User agrees to have his/her personal data collected for the Operator's administrative needs only. The User hereby expressly gives consent to the storage of his/her name, email and any additional information regarding the User in the Operator's database. Concurrently, the User grants permission to the Operator to receive e-mail messages related to Accent Artisan, existing subscriptions and related services. The User can opt out of these messages in the footer of each bulk email at any time.

VIII. Final provisions

1. By creating a user account, the User agrees to these terms and conditions.
2. These Terms and Conditions apply as stated on the Operator's website on the day of the User’s registration and first entry into the Application.
3. These Terms and Conditions may be unilaterally changed by the Operator, always with effect after the expiry of a 14-day period from the date of the notice of change publication on the Operator's website Terms and Conditions.
